Divorce is a fairly straight forward process, however there are a few requirements to be aware of. If a couple has been validly married, they are able to apply for a divorce after they have been separated for a minimum of 12 months. If there are any children involved the couple has to have made appropriate arrangements for the care of these children.
Property Settlement is a process of the division of property, assets and liabilities that have come from the relationship. If the parties involved are not amicable in their decision, an application can be to the Court in order for the Court to determine the division.
Children’s Matters – Unfortunately when a relationship breaks down, children tend to suffer the most. When parents cannot come to an agreement as to the living arrangements of the children, an application can be made to the Court for a decision as to the best arrangements for the children involved. The Court can also make decisions in relation to spouse maintenance.
